Overview:
The Massachusetts Privacy Law (MA 201 CMR 17), designed to protect the personal identifiable information (PII) of the state's residents. It will mandate strong controls, including a requirement that organizations send out notifications when breaches occur that include the PII of Massachusetts' residents. The law also requires use of specific technical safeguards that ensure organizations take preventative measures and employ IT "best practices" for the protection of PII. But the law generates controversy for a number of reasons, including its potential reach beyond state borders and compliance position in relation to existing federal laws.
